WHAT 36 NEW DUBAI EXPO 2020 DEALS MEAN FOR TANZANIA


The 36 Memorandums of Understanding (MoU's) were signed during the Tanzania Business and Investment Forum in Dubai and aim to generate investments worth 7.49 billion US Dollars (about 17.8 trillion Shillings) and create 204,575 jobs over the next four years.

The agreements were reached between the two governments and between private sectors from Tanzania and the UAE, in an event graced by the Tanzanian President Samia Suluhu Hassan.

Among key sectors which will benefit from investments are energy, agriculture, tourism, infrastructure, transportation, textiles, ICT, construction.

Twelve MoU's were signed between the Tanzanian government and investors, while 23 MoU's were signed between Tanzanian companies and various investors seeking joint ventures or collaboration in various sectors in the economy.

Similarly, one MoU was signed between Zanzibar's Ministry of Trade and Industrial Development and potential investors in the tourism industry, specifically in the area of conference tourism.

President Samia Suluhu Hassan addresses participants at the Tanzania Business Forum - Dubai Expo 2020 in the United Arab Emirates yesterday.

President Samia Suluhu Hassan yesterday made an assurance to the business opportunity in the United Arab Emirates (UAE) that Tanzania was ready to take off.

The Head of State made the assurance as part of her ambitious aspirations to continue unlocking Tanzania to the rest of the world.

"Tanzania is ready to take off... we are ready to take off and let's fly together. Be assured of my government's commitment to continue creating a better environment for doing business", stated President Samia yesterday.

She was speaking at a meeting between the UAE and Tanzania business community during the Business and Investment Forum held in Dubai yesterday as part of the special day for Tanzania at the Expo Dubai 2020.

STANBIC BANK KEEN ON SUPPORTING THE MINING SECTOR

Stanbic Bank’s Corporate Banking Manager - Aboubakar Massinda, highlights the bank's role in supporting the government's vision of increasing contribution of the Mining sector to the national GDP. This was during a panel discussion at the Tanzania Mineral and Mining Investment Conference held at Julius Nyerere International Convention Centre in Dar es Salaam.

On 22 February 2022, Stanbic Bank Tanzania sponsored the Tanzania Mineral and Mining Investment Conference held at the Julius Nyerere International Convention Centre in Dar es Salaam. As part of the bank's role to support conversations around initiatives to drive the growth of the Mining sector.

We sat with Stanbic Bank Tanzania’s Corporate Banking Manager, Aboubakar Massinda to discuss the bank’s contribution to the mining sector and share his perspectives on the other elements that drive the sector’s growth and support the government vision to raise mining's contribution to Tanzania's GDP from the current 6.7 percent to 10 percent by 2025.

QUESTIONS

Q: The bank has been playing a critical role in supporting the country’s key sectors such as Mining. What informed Stanbic Bank Tanzania’s decision to participate in this year’s 4th Tanzania international Minerals and Mining Investment Conference?

A: One of our priorities for the bank this year is to increase our contribution towards the growth of the mining sector, hence our decision to sponsor the conference this year. In addition to this, Stanbic Bank Tanzania is a member of the Tanzania Chamber of Mines, this partnership allows us to be in the front and centre of all matters related to mining in the country. As leading experts in the mining sector from a banking perspective, we are keen to contribute to dialogue that will shape policy and decisions in the mining sector.

OIL SURGES TO $100 A BARREL FOR FIRST TIME SINCE 2014

Russian President Vladimir Putin announced a military assault against Ukraine early Thursday morning in Russia.

Russia is a large exporter of oil and gas, and any supply disruption could worsen energy inflation.European benchmark natural gas and power prices soared 30% in response.

Crude oil hit $100 a barrel for the first time in over seven years on Thursday, as energy prices surged after Russian President Vladimir Putin announced a military assault against Ukraine.

Reports of explosions and flares across Ukraine came minutes after the speech broadcast early morning in Russia.

Brent crude futures breached $100 a barrel in Asia for the first time since 2014. The price was last up 5.67% at $99.38 at 3:27 a.m. ET. US benchmark West Texas Intermediate futures were also up 5.92% at $97.55 a barrel.

European natural gas futures roared higher, with Dutch and UK benchmark prices rising by 30% in the space of a day the most in almost two months while key German power prices rose 28%.

Russia is one of the largest exporters of oil and gas, and investors fear the crisis could disrupt energy supply, which in turn would add to already red-hot global consumer inflation. It supplies roughly 40% of the European Union's natural gas and any threat to that supply could drive regional prices even higher, analysts said.

"What we have said about oil is even more true of natural gas: any outage of Russian deliveries would be virtually impossible to offset, especially for Europe," strategists at Commerzbank said in a daily note. "Though European gas stocks should last until the end of the winter, the restocking needed for next winter would then be hardly possible," they added.

Russia competes with the United States and Saudi Arabia for the top spot in exports and was the world's third-largest oil exporter in 2020, so "thescale of disruptionandcorresponding difficulty in substituting for lost Russian supplymean thatprice sensitivity to Russian oil disruptions are high," said Vishnu Varathan, Mizuho Bank's head of economics and strategy in a note sent on Thursday before Putin's announcement.

ATCL TO ENTER INTO PARTNERSHIP WITH KLM AND EMIRATES


Dar es Salaam - Air Tanzania Company Limited (ATCL) is in the final stages of signing partnership agreements with Emirates and the Royal Dutch Airline- KLM that will help connect its passengers to destinations in the United States and Europe.

The national carrier also said it was in the final stages of talks with China’s Aviation authorities over a similar arrangement.

“These companies are the largest in the world as an effort to expand the network will start partnerships with them while we prepare to go to the United States and Europe,” said the ATCL managing director Ladislaus Matindi.

He was speaking during the tour by deputy Permanent Secretary in the Ministry of Works and Transport Dr Ally Possi adding that the carrier is currently working with Rwandair, Ethiopian airlines, Qatar Airways and Air India.

Absa Bank Tanzania has launched the Fifth Africa Annual Africa Financial Markets Index (AFMI) 2021 at an event officiated by the Governor of Bank of Tanzania, Prof. Florens Luoga. The starting point for the Absa Financial Markets Index (AFMI) is to support effective financial market development, with the core target of the Index being to facilitate the right conversations, among all financial markets’ stakeholders, in ensuring that Africa is well placed to attract global capital. The index successfully captures a huge mix of African economies from Seychelles to Nigeria, while the Eastern parts of the continent are represented by Tanzania, Kenya, Ethiopia, Uganda, and Rwanda. As a reflection of the global push towards sustainability, this is the first year that the index has included ESG indicators. The availability of sustainable finance products, such as green bonds and equities, now contributes to countries’ scores.

The Kilimanjaro Regional Commissioner (RC) Stephen Kagaigai has commended the management of Absa Bank Tanzania Limited, for its significant contribution to improving the environment in the country, including within the region.

Kagaigai made the remarks on Wednesday when he receiving a total of 2,100 seedlings of indigenous trees from the bank's management at the RC’s office, in Moshi.

“Different efforts meant to improve the environment have contributed significantly to the ongoing well-being of our region’s environment; I commend Absa for the contribution, may I take this opportunity to urge other institutions to emulate your institution”, he said and added that the government will continue supporting different investors to achieve their goals.

He also commended the management of Absa Bank Tanzania Limited for providing indigenous tree seedlings that contribute significantly to the conservation of water sources.

TANZANIA na Benki ya Dunia zimetiliana saini mikataba miwili ya mkopo wenye masharti nafuu wenye thamani ya dola za Marekani milioni 650 sawa na shilingi trilioni 1.5 za kitanzania kwa ajili ya kugharamia utekelezaji wa mradi wa kuboresha elimu ya msingi (BOOST) na mradi wa kuimarisha usalama wa umiliki wa ardhi nchini.

Mikataba hiyo imesainiwa na Katibu Mkuu na Mlipaji Mkuu wa Serikali kutoka Wizara ya Fedha na Mipango Bw. Emmanuel Tutuba kwa niaba ya Serikali na Mkurugenzi wa Benki ya Dunia nchini Tanzania Bi. Mara Warwick.

Akizungumza baada ya kusainiwa kwa mikataba hiyo, Bw. Tutuba alisema kuwa fedha hizo zimetolewa na Benki ya Dunia kupitia mgao wa masharti nafuu wa Mzunguko wa IDA 19, ambapo dola za Marekani milioni 500 zitatumika kuboresha elimu ya msingi na kiasi kingine cha dola za Marekani milioni 150 kitatumika kuimarisha usalama wa milki za ardhi hapa nchini.

Bw. Tutuba alisema kuwa miradi iliyo chini ya Mikataba iliyosainiwa inatekeleza Mpango wa Tatu wa Taifa wa Maendeleo wa Miaka Mitano (2021/22–2025/26) na ni sehemu ya ajenda kuu ya Serikali ya Awamu ya Sita chini ya Mh. Rais Samia Suluhu Hassan, inayolenga kujenga uchumi shindani wa viwanda kwa maendeleo ya watu kupitia mikakati mbalimbali.

CLYDE & CO UPDATER - DOING BUSINESS IN TANZANIA: TRADE AND SERVICE MARKS REGISTRATION


In this month’s briefing, we look at how entities engaged in doing business in mainland Tanzania can protect their trade and service marks (Trademarks).

Trademark registration is governed by the Trade and Service Marks Act of 1986 and Trade and Service Marks Regulations of 2000, as amended. Trademark registration is done through the Business Registrations and Licensing Agency’s (BRELA) Online Registration System (ORS). It is important to take note of some of the information and documents required in an application for Trademark registration:
  1. A duly completed consolidated form.
  2. Name, occupation and address of the applicant.
  3. A power of attorney to appoint a Trademark agent (if required).
  4. An image of the proposed mark (except for word marks in ordinary type). 
  5. A priority document (if applicable) with a verified English translation, if the proposed Trademark is in a language other than English.
  6. A specification of Nice Classification (NCL) description on the goods and services for which the Trademark is to be registered.
Further to paragraph “6” above, NCL is an international classification of goods and services established by the Nice Agreement of 1957 and applies to Trademark registration.

The application fee is TZS 65,000 (approximately USD 28) which includes TZS 50,000 (approximately USD 22) registration fee and TZS 15,000 (approximately USD 6) advertisement fee. Please note that fees may change over a specific period.

Once the required information is filed on ORS and accepted, BRELA will advertise it on the Trademark journal.

CLYDE & CO UPDATER - PERFORMANCE SECURITY BONDS IN TANZANIA


A Performance Security Bond (Performance Bond) is a contract of guarantee in which one party (the Guarantor) promises to discharge the liability of a third party in the event of default. Performance Bonds are designed to ensure the performance of duties by parties to a contract. In this month’s legal update, we highlight the key aspects of Performance Bonds and their implications in Tanzania.

The following laws are applicable to this article:
  • The Banking and Financial Institutions Act No. 5 of 2006 (the BFI Act)
  • The Law of Contract Act, Cap 345 R.E. 2019 (the LCA)
  • The Public Private Partnership Act No. 18 of 2010 (as amended)
  • The Public Procurement Regulations, GN No. 446 of 2013 (as amended) (the Regulations)
Performance Bonds are governed by the provisions of the LCA. It should be noted that banks and financial institutions are among the main providers of Performance Bonds in Tanzania alongside insurance companies. Banks and financial institutions are permitted to issue guarantees pursuant to section 24 (1) (f) of the BFI Act.

How Performance Bonds are commonly used in Tanzania

In Tanzania, Performance Bonds are commonly used in public-private partnerships (PPPs) where a Government agency/authority (the Beneficiary) seeks expertise from a private entity (the Supplier). Under such circumstances, the Beneficiary would require the Supplier to obtain a Performance Bond as a guarantee to perform the required services.

The submission of a Performance Bond under the PPP regime is provided for under regulation 29 (1) of the Regulations which provides as follows:

“(1) The procuring entity shall require the successful tenderer to submit a performance security to guarantee the faithful performance of the contract and payment of all labourers, suppliers, mechanics and subcontractors, if any”.

PRESIDENT SAMIA'S REWARDING TOUR IN FRANCE AND BELGIUM

President Samia Suluhu Hassan addresses Dar es Salaam residents after arriving back in the country yesterday from a week-long working tour in France and Belgium.

President Samia Suluhu Hassan yesterday arrived back in the country after a working tour abroad, highlighting achievements recorded including securing a grant of 425 million Euros (about TShs. 1.15 trillion) from the European Comission to fund various development projects.

Speaking to some residents who gathered at Terminal I of the Julius Nyerere International Airport (JNIA) to receive her following a week-long tour in France and Belgium, President Samia said Tanzania will benefit from a number of projects as part of her European working tour.

She mentioned some of the achievements to be expected to include massive rehabilitation of Terminal II of JNIA as well as implementation of phase five of the Bus Rapid Transport (BRT) project in the Commercial City of Dar es Salaam.

"During the visit, we also engaged our partners who advised us on switching to electric buses from the conventional buses either in Dar es Salaam or Dodoma for the BRT lanes," President Samia stated.
