When Mishi Dustan Mtili’s name was called to the dais to receive the Best Safari Guide in the Female category award for 2019 a fortnight ago, she was extremely proud.

The female field the guide has already crafted a niche in ecotourism, a field that is mostly dominated by men.

But for her, this was nothing short of a surprise.

“I still have no idea of who nominated me for the awards, I just received a call from one of the organizers inquiring of my availability for the award ceremony,” recalls Mishi as she opens up about the gala event that took place at Kibo Palace Hotel in Arusha early this June.

Despite her the bewilderment on her nomination, the mother-of-two and a safari guide with Singita Grumeti, still believes that she deservedly won the award which was presented to her by the Minister for Natural Resources and Tourism Hon. Dr. Hamis Kigwangalla.

CLYDE & CO UPDATER - LIQUIDATED DAMAGES IN THE TANZANIAN CONSTRUCTION INDUSTRY

As the construction industry continues to develop in Tanzania, the use of international standard contracts has increased. In particular, we have seen the FIDIC (Fédération Internationale Des Ingénieurs-Conseils) standard form contracts used more frequently in this jurisdiction.

It is standard practice for most construction contracts, including FIDIC contracts, to contain a liquidated damages clause. As liquidated damages (LDs) provide for a pre-agreed rate of damages, payable to the employer by the contractor in the event of a contractor's delay in performing the work, the risk of delay for the employer is mitigated.

LDs, as opposed to general damages, do not require the claimant to prove that the losses claimed have actually been suffered. As such, the contract will provide for a genuine and fixed pre-agreed estimate of loss. Often this is calculated based on the amount of loss that will be incurred on a daily basis if the work is not completed on time.

TEN REASONS WHY WE SHOULD WELCOME DR CONGO TO THE EAST AFRICAN COMMUNITY

Democratic Republic of the Congo President Felix Tshisekedi in Kinshasa on January 24, 2019. The DRC wants to join the East African Community.
1. Let us first deal with the big cynical view that was among the first to emerge when news came that the Democratic Republic of Congo has applied to join the East African Community: That Rwanda’s leadership wants to score a big point by bringing the giant state into the fold during its chairmanship.

Well, if Rwanda is selfishly seeking to boost its stature by recruiting DRC, then that kind of selfishness, which stands to benefit 275 million people (EAC has 193 million), should be welcomed. What all members should do is to ensure that the spirit and letter of the Community charter are strictly adhered to.

2. There is also the little matter of whether DRC is in East Africa. Indeed, it shares borders with five members of the Community – South Sudan, Uganda, Rwanda, Burundi and Tanzania. That is more than any other of the members. In that respect, DRC is the most qualified country to join the EAC.

3. There are always two sides to a coin. Right now the image of the EAC is less than bright, featuring Rwanda in the chair having uneasy relations with Uganda and Burundi; the Community Secretariat in Arusha drowning in financial scandals and most member states not remitting their contributions promptly. But this is a phase that shouldn’t stifle EAC’s ambition to be a leading light for regional integration. Admitting Congo makes a big aspirational statement and sets higher targets for the continent.

ROSTAM SALUTES PRESIDENT JOHN MAGUFULI FOR IDEAL BUSINESS CLIMATE

After quitting politics eight years ago, a prominent businessman, Rostam Aziz has also been playing low profile in the country's investment playground.

But yesterday, the businessman explained why he had now decided to reinvest in the country after all those years.

He was speaking in Dar es Salaam at an event where President John Magufuli launched a liquefied Petroleum Gas (LPG) depot belonging to Taifa Gas Limited. Rostam is the Chairman of the Board of Directors of Taifa Gas Limited. The depot located near Nyerere Bridge in Kigamboni, is the largest in East and Sub-Saharan Africa, with a capacity of storing 7,650 metric tonnes, followed by one in South Africa with a 5,200 metric tonnes capacity.

The 150-billion investment facility is for receiving and storing the LPG for industrial and domestic uses within Tanzania, other East African countries as well as beyond the region.

DR CONGO ENTRY INTO EAC WILL BE A GAME CHANGER

Mourners react as DR Congo former Prime Minister Etienne Tshisekedi's body arrives in Kinshasa, on May 31, 2019. The country offers a market of 81 million people, which is almost half the size of the East African Community.
The Democratic Republic of Congo has applied to join the East African Community in a move that could potentially expand the boundaries of the trading bloc to the Atlantic coast of Africa.

The application comes following months of talks between DR Congo President Felix Tshisekedi and Rwanda President Paul Kagame, who chairs the East African Community.

Sources familiar with the diplomatic talks that preceded the formal application say most EAC member states are enthusiastic about DR Congo’s membership.

The DRC officially communicated its intention to join the EAC in a letter to President Kagame dated June 8. Kinshasa said its desire to join the bloc was informed by its increasing trade ties with the region.

In response, President Kagame directed the EAC Secretariat to table DR Congo’s application for discussion at the next Heads of State Summit in November.

If it meets the admission requirements, members will vote on its admission.

GAME CHANGER

The potential membership of the Central African country is being viewed as a game-changer, given its natural resources wealth and a huge consumer market of 81 million people.

THE FUTURE OF BANKING - PART ONE

By Kelvin Mkwawa, Seasoned Banker.
Slowing economic activity in Tanzania has impacted banking soundness indicators, which have shown some signs of weakening: non-performing loans (NPLs) are still a challenge, banks’ lending activities typically focus on a few key sectors which leads to high portfolio concentration risk, and a limited number of large corporates. Banks need to reinvent to remain competitive. In Tanzania, where the majority of the population lacks access to formal financial services (only 17% of the population are banked), mobile money has taken off and filled that gap left by banks. Mobile network operators are the dominant players in Tanzania’s banking ecosystem. There are more active mobile money agents than there are bank branches and ATMs in Tanzania.

Furthermore, technology companies (Fintechs) start-ups are channelling their focus on catering to the financially excluded Tanzanians who do not qualify for traditional financial services. In addition, with the number of investments on digital financial services from Fintechs and telecommunication companies, there is no doubt that the banking sector faces major disruption. So what will the banking industry look like in the next five or ten years? This is the question many bank CEO and shareholders should ask themselves. In this article, I will share what I think is the future of banking, and what banks need to do to not be left behind.

In my humble opinion, the future of the banking industry will depend on its ability to leverage the power of customer insights, advanced analytics and digital technology to provide services that help today’s tech-savvy customers manage their finances and better manage their daily lives. As technology advances in the next five to fifteen years, consumers will rely on their virtual assistants to do their banking and simplifying their day to day activities. Banks need to shift their mindset as well. You might argue that this doesn’t concern us (developing countries) as the state of advanced technology is at the earliest stage, but you can’t deny that what happens in developed markets has effects on our local markets as well. Hence banks should shift their focus from servicing the customers physically to investing in providing digital financing while also working on strengthening their security features and mechanisms to safeguard customer’s information hence improve consumer’s trust in digital finance.

Tanzanians have been advised to invest in financial markets in order to reap the sustainable rewards emanating from a wide range of money-making products available there, but which encouragingly entails but modest initial capital outlays.

The main aim of the workshop, held at the Mlimani Campus, was to fine-tune the level of understanding of financial markets of the students in order to prepare them to utilize opportunities available in the markets once they complete studies.

EAST AFRICA IS THE FASTEST GROWING REGION FOR THE FIFTH STRAIGHT YEAR, DRC & SOMALIA ASK TO JOIN EAC

Kenya's Cabinet Secretary for National Treasury (Finance Minister) Henry Rotich holds up a briefcase containing the Government Budget for the 2019/20 fiscal year in Nairobi, Kenya, June 13, 2019.
East Africa plans to fund its next year by expanding and streamlining their tax bases, exempting strategic industries and goods from taxes, and boosting local industries.

The finance ministers of four of the six members of the East African Community (EAC) presented their national budgets before their respective parliaments on Thursday. Kenya’s budget remains the biggest in the region at nearly $30 billion. Tanzania’s 2019/2020 budget is $14.3 bn, Uganda $9.1bn, and Rwanda $3.2bn.

At a total of $56.6bn, the budgets are ambitious in their continued spending on infrastructure which has plunged the region into unprecedented levels of public debt.

Part of the common solution to fill the coffers seems to be to attract investments in specific sectors and boost tax collection.

The other two members, Burundi and South Sudan, have not synchronized their financial years with the other states yet.

  • Two other states, Somalia and the Democratic Republic of Congo, are being considered for membership to the bloc, which would bring the total number to eight. Congolese President Felix Tshisekedi wrote a formal request to the current chair of the community, Paul Kagame, on June 8th expressing his country’s desire to join the six-member bloc.
  • Tshisekedi has been on shuttle diplomacy in the region before the formal request, and Congo, which borders all but one of the current EAC members, is likely to be considered for membership during this year’s Summit in November.
East Africa is the fastest growing region in Africa for the fifth straight year, according to the African Development Bank’s (AfDB) Economic Outlook for 2019.
